("Maple Root Garden Services Ltd.", "we", "us", or "our") to the customer, client, or user ("you" or "your"). By requesting, scheduling, paying for, or otherwise receiving any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use or receive our services. These Terms apply to all services provided by Maple Root Garden Services Ltd. unless we agree otherwise in writing.

2. Scope of Services

Maple Root Garden Services Ltd. provides residential and commercial garden and lawn maintenance services, which may include:

  • Lawn and garden maintenance
  • Seasonal yard cleanup
  • Planting and flower bed design
  • Shrub and hedge trimming
  • Mulching and soil improvement
  • Irrigation system checks
  • Garden bed weeding and edging

The exact scope, frequency, timing, materials, and deliverables for each engagement will be determined by the service estimate, proposal, work order, invoice, booking confirmation, or other written agreement issued by Maple Root Garden Services Ltd.

We may refuse, suspend, or modify services where site conditions, weather, access limitations, safety concerns, legal restrictions, or other circumstances make performance impractical or unsafe.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, complete, and up-to-date information regarding the property and requested services.
  • Ensure safe, unobstructed access to the property, including gates, utility areas, and work zones.
  • Notify us in advance of any known hazards, including but not limited to pets, underground utilities, hidden obstacles, bees/wasps, contaminated soil, unstable structures, sprinkler heads, or fragile items.
  • Secure or remove personal property, valuables, decorations, toys, outdoor furniture, and other items that may be damaged or interfere with work.
  • Obtain any required permissions, approvals, permits, or consents from landlords, property managers, condominium boards, neighbors, or other third parties.
  • Ensure that any irrigation, electrical, or other systems affected by our services are disclosed to us prior to service.
  • Promptly review completed work and raise any concerns within a reasonable time after service completion.

You acknowledge that natural landscaping and garden work involve inherent risks, including plant loss, weather-related changes, soil disturbance, and minor incidental damage consistent with ordinary performance of such services.

4. Payment Terms and Conditions

Unless otherwise agreed in writing, fees for services are due upon receipt of invoice or at the time specified in the estimate, booking confirmation, or work order. We may require a deposit, prepayment, or milestone payment for certain services, large projects, seasonal work, special materials, or repeat visits.

  • All prices are in Canadian dollars unless stated otherwise.
  • Applicable taxes, including GST/HST/PST where applicable, will be added to the invoice.
  • Invoices not paid by the due date may be subject to late charges permitted by law and/or collection costs to the extent legally recoverable.
  • If payment is made by credit card or other electronic method, you authorize us or our payment processor to charge the authorized amount.
  • You are responsible for any chargeback fees, bank fees, or payment reversal costs arising from disputed or reversed payments, except where prohibited by law.

Estimates are based on the information available at the time of quotation. If site conditions differ materially from what was disclosed, additional charges may apply after notice to you.

5. Cancellation and Refund Policy

Cancellations or rescheduling requests should be made as early as possible by contacting Maple Root Garden Services Ltd. For scheduled visits, we may require reasonable advance notice. If you cancel late, fail to provide access, or request rescheduling after our team has been dispatched, you may be charged a cancellation fee or the full service fee to the extent permitted by law and as disclosed in your booking terms.

Refunds, if any, are handled on a case-by-case basis and may be issued where services were not performed due to our error, where required by law, or where otherwise approved by Maple Root Garden Services Ltd. Refunds are generally not available for:

  • Work already completed or partially completed;
  • Changes in weather, seasonal conditions, or plant health factors beyond our control;
  • Customer-requested changes after work has begun;
  • Issues caused by hidden site conditions, undisclosed hazards, or inaccurate information provided by you.

If materials have been purchased or special-order items arranged at your request, those costs may be non-refundable.

6. Liability Limitations

To the maximum extent permitted by applicable Canadian law, Maple Root Garden Services Ltd. shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of use, or loss of enjoyment, arising out of or related to the services or these Terms.

We are not responsible for:

  • Pre-existing conditions, poor soil quality, pest infestations, disease, drought, storm damage, frost, or other natural causes;
  • Damage resulting from hidden or undisclosed hazards, defective infrastructure, or customer instructions contrary to our recommendations;
  • Normal wear, tear, or plant stress associated with landscaping, trimming, planting, or soil work;
  • Delays or non-performance caused by weather, supplier shortages, access issues, or other matters beyond our control.

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, wilful misconduct, or other liability that cannot be excluded under applicable law.
